These terms govern the sale of the AstroTransform digital content and service to consumers and businesses. They form part of the contract you enter into when you place an order.

1. Seller

Jan Rubeš, company ID 09864741, registered office Zvoleněves 49, 273 25 Zvoleněves, Czech Republic. The seller is not registered for VAT — the tax regime is explained in clause 4. Registered in the Czech Trade Licensing Register kept by the Municipal Office of Slaný. Contact email: info@astrotransform.com. The address for complaints and withdrawal notices is the registered office above. Consumer protection supervision is carried out by the Czech Trade Inspection Authority (Česká obchodní inspekce).

2. What you are buying

AstroTransform converts your WordPress site into an Astro.js project with a built-in admin. The deliverable is an archive (ZIP) with source code, content and instructions — digital content that you deploy yourself. We do not provide hosting or run the site for you. The scope is defined by the package described in the pricing section on astrotransform.com. The site analysis and report are free and create no obligation to order. The result is an automated conversion. We do not warrant that it will look or behave identically to the original site. For pages built with visual builders (Elementor, Divi, WPBakery) we take the layout from the rendered site — coloured bands, columns and buttons stay. We do not carry over the builder plugin itself, so details (animations, sliders) may look different and pages are edited in our admin from then on, not in the original builder. The free report you see before paying lists which pages we managed to capture this way; pages the report marks as not captured keep only their text and images. E-commerce functionality (WooCommerce) is not converted at all.

3. Order, formation of contract and delivery

You place an order in the app using the payment button. Before submitting it you see the price, the scope and these terms, and you can review and correct your order. The contract is concluded when we confirm receipt of your payment; we send the order confirmation by email. We begin performance without undue delay after payment. Delivery means making the archive available for download in your account. The archive and the rest of the job content (analysis results, media, generated site) stay available for download for 12 months after the job is finished — counted from the completion of the analysis or from the first download of the output, whichever is later. 30 days before the period ends we email you a reminder to download the output. Once it ends we permanently delete the content even without a request from you and nothing can be downloaded from the project any more; the project record, orders and invoices remain. An archive you have downloaded is yours and is not affected.

4. Price, VAT and invoice

Prices in the pricing section are final, per site and one-time. Nothing is added on top. We are not registered for VAT. No VAT is added to the price and none is shown on the invoice — what you see in the price list is what you pay. For Czech VAT purposes the seller is a so-called identified person and holds the number CZ9510170791. That number only serves for declaring tax on services bought from abroad; it does not make the seller a VAT payer and does not entitle you to deduct any VAT from our invoice. Payment is taken upfront through the Stripe payment gateway. Card details are entered directly with Stripe; we never see them. We issue the invoice electronically and send it by email; you can also find it under Settings → Billing. You agree to receiving invoices in electronic form.

5. Your site, your content and your declaration

The generated project and the exported data are yours. We claim no rights to your site or its content and use them only to carry out the migration. By ordering you declare that you own the site being migrated, or that the owner has authorised you to migrate it, and that nothing prevents you from giving us access to its content. If that turns out not to be the case, we may stop the migration, delete the data and withdraw from the contract. Any resulting damage and third-party claims are yours to bear. If you believe someone used our service to migrate your site without your consent, write to info@astrotransform.com and show your relationship to the domain. We will review the data and delete it where justified.

6. Withdrawal within 14 days (consumers only)

If you are a consumer, you have the right to withdraw from this distance contract within 14 days without giving a reason, under Section 1829 et seq. of the Czech Civil Code. The period runs from the day the contract is concluded. To withdraw, send an unambiguous statement to info@astrotransform.com or a letter to our registered office; you may use the model withdrawal form in the annex to these terms. We refund using the same means of payment you used, within 14 days of withdrawal at the latest. IMPORTANT — loss of the right: this is digital content not supplied on a tangible medium. Before paying you therefore tick an express consent with this wording: “I expressly agree that the supply of digital content begins before the 14-day withdrawal period expires, and I acknowledge that I thereby lose my right to withdraw from the contract.” Without that consent we do not start the payment. We begin supplying the digital content without undue delay after payment (clause 3). From that moment you no longer have the right to withdraw from the contract under Section 1837(l) of the Czech Civil Code. We store the consent and its exact wording with your order and confirm it in the payment receipt email. Your rights in case of defects under clause 7 are not affected.

7. Defects and complaints

We are liable for the delivered digital content matching the agreed scope of the package and for it being runnable following the enclosed instructions. You may report a defect within two years of delivery. Send complaints to info@astrotransform.com. Describe what does not work, give the address of the original site and the project name; a screenshot helps. We confirm receipt of the complaint and settle it within 30 days at the latest, unless we agree otherwise, and let you know the outcome. If the defect can be remedied, you are entitled to have it remedied (we fix the conversion and regenerate the output). If we fail to remedy it within a reasonable time, you may ask for a proportionate discount or withdraw from the contract. Differences in appearance or functionality from the original site that we flag in the free report and in clause 2 above are not defects.

8. Liability

Back up your site before migrating. We never write to your WordPress — we only read content through an API key that you issue yourself. We are not liable for indirect damage, lost profit, or outages of third-party services (Cloudflare, GitHub, Stripe). Towards businesses our liability is capped at the price paid; nothing in these terms limits the statutory rights of consumers. Once the site is deployed, its operation, security and backups are your responsibility as its operator.

9. Acceptable use

You must not use the service to migrate someone else's site without the owner's consent, to circumvent technical protection measures, to bulk-download third-party content, or for anything that breaks the law or infringes the rights of others. You are responsible for activity under your account; never share your credentials or API keys. If these rules are broken we may restrict or close the account and stop work in progress.

10. Out-of-court resolution of consumer disputes

If we cannot resolve a dispute directly, you as a consumer may turn to the Czech Trade Inspection Authority, the competent body for out-of-court resolution of consumer disputes. Česká obchodní inspekce, Ústřední inspektorát — oddělení ADR, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, adr.coi.cz, www.coi.cz. The procedure is free of charge for consumers and can be started within one year of the day you first raised your claim with us.

11. Personal data

How we handle personal data is described in the separate Privacy Policy. Migration involves giving us access to your site's content, which may contain personal data of third parties. To that extent we act as your processor and follow your instructions; the details are set out in a data processing agreement [TO FILL IN: link to the data processing agreement or how to request it].

12. Changes and governing law

We may change these terms. A concluded contract is always governed by the version in force when the order was placed; the version you accepted is stored with your order. The contract and these terms are governed by the law of the Czech Republic, in particular the Civil Code and the Consumer Protection Act. This does not affect the rights a consumer has under the law of their country of habitual residence. Czech courts have jurisdiction over disputes.
